Disputed applications for payment
If you have submitted an application for payment which has been disputed or ignored, we can help recover the amount outstanding.
In the UK and Irish construction industries, parties to construction contracts have a statutory right to interim payment – for more detail, see our user guides to payment in England, Wales and Scotland, Northern Ireland, and Ireland.
If your application for payment has been ignored, or if the payer has failed to respond to it appropriately, then the amount set out in your application for payment could potentially be payable in full. We use our expert knowledge of the law to advise clients when this is the case. We then pursue the full amount in Adjudication.
If your application for payment is disputed, by the payer issuing a payment notice or pay less notice against it, then we can assist you in resolving this dispute. We start this process by reviewing the merits of your claim. We then proceed to devise a strategy to resolve the dispute via a combination of Negotiation, Mediation and/or Adjudication.
Unpaid invoices
If you have submitted an invoice for work certified, but your invoice has been ignored, we can help recover the amount outstanding. We adopt a multi-tiered approach in recovering unpaid invoices:
- Evaluate claim and compensation
- Demand letter
- Telephone negotiation
- Statutory demand
- Legal action
Outstanding retention
Retention is a common feature in most construction contracts. Quite often the “final release of retention” is due to be paid a year or more after the works are completed. Due to the passage of time and people moving on to different projects, recovering outstanding retention is not always straightforward.
We have a standardised process for recovering outstanding retention, which is tried and tested. We have a number of retainer clients who trust us to deal with all of their outstanding retention claims.
